Terms of Service

By downloading, installing, or using the Ferne mobile application ("App"), operated by Ferne.care ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App.

Ferne is a menopause and perimenopause symptom tracking application that allows users to:

• Log and track symptoms including hot flashes, mood, sleep, energy, and more
• Receive AI-powered insights and pattern analysis based on their logged data
• Generate PDF reports for sharing with healthcare providers
• Track menstrual cycle changes and identify triggers

Ferne is a wellness tracking tool and is not a medical device or service.

To use Ferne, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years of age to create an account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Ferne offers a free tier and premium subscription plans. Premium subscriptions are processed through Apple App Store or Google Play using in-app purchase mechanisms.

• Free Trial: Premium plans include a 7-day free trial for new subscribers
• Billing: Subscriptions are billed on a recurring basis (monthly or annually) until cancelled
• Cancellation: You may cancel at any time through your App Store or Google Play account settings
• Refunds: Refund requests are handled according to Apple App Store or Google Play refund policies
• Price Changes: We reserve the right to change subscription prices with reasonable notice

You agree not to use the App to:

• Violate any applicable laws or regulations
• Upload or transmit malicious code or harmful content
• Attempt to gain unauthorized access to our systems or other users' data
• Use the App for any commercial purpose without our written consent
• Reverse engineer, decompile, or disassemble any part of the App
• Misrepresent your identity or impersonate any person or entity

Ferne is a personal wellness tracking tool and is not a substitute for professional medical advice, diagnosis, or treatment.

The information and insights provided by the App are for informational purposes only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the App.

If you are experiencing a medical emergency, call your local emergency services immediately.

The App and all its content, features, and functionality — including but not limited to text, graphics, logos, icons, and software — are owned by Ferne.care (Kath Vik Solutions) and are protected by intellectual property laws.

You retain ownership of the health data you log in the App. By using the App, you grant us a limited licence to process your data solely for the purpose of providing our services to you.

The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

We are not responsible for any decisions you make based on information provided by the App. The AI-powered insights are generated automatically and may not always be accurate or applicable to your specific situation.

To the maximum extent permitted by applicable law, Ferne.care (Kath Vik Solutions) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by deleting your account through the App settings or by contacting us at ferne.app@gmail.com. Upon termination, your right to use the App will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Canada.
